These Terms of Service (the "Terms") set out the conditions for using the application "FavoWeather - Custom Weather" (the "App") provided by FavoBase ("we", "us" or "our"). By using the App, you are deemed to have agreed to these Terms.

Article 1 (Scope)

  1. These Terms define the rights and obligations between you and us regarding your use of the App and apply to every aspect of your use of the App.
  2. If there is any inconsistency between these Terms and any document that forms part of these Terms, these Terms shall prevail.

Article 2 (Definitions)

The following terms have the meanings set out below.

  1. "App" means the application named "FavoWeather - Custom Weather" provided by us.
  2. "User" means any individual who downloads, installs and uses the App.
  3. "Content" means text, images, video, audio, software, programs and other information provided in the App.
  4. "User Images" means images that the User provides in order to set them as weather icons or backgrounds in the App.

Article 3 (License)

  1. Subject to your compliance with these Terms, we grant you a non-exclusive right to use the App.
  2. You may use the App for personal purposes only; commercial use is not permitted.
  3. You may not transfer, lend or redistribute the App to any third party.

Article 4 (Prohibited Conduct)

When using the App, you must not:

  1. violate any law or public order and morals;
  2. infringe the intellectual property rights, portrait rights, privacy, reputation or other rights or interests of us or any third party;
  3. reverse engineer, decompile, disassemble or otherwise analyze the source code of the App;
  4. tamper with the functions of the App;
  5. place an excessive load on the servers or networks related to the App;
  6. interfere with the operation of the App; or
  7. engage in any other conduct that we deem inappropriate.

Article 5 (User Images)

  1. All rights in User Images belong to you or the rightful owner of the image. We do not acquire any rights in them.
  2. You may only set images that you are legally permitted to use. When setting images in which a third party holds rights, you are responsible for checking and complying with the applicable license terms.
  3. User Images are used only on your device and are never sent to us (see the Privacy Policy for details).
  4. Any dispute with a third party arising from User Images shall be resolved at your own responsibility and expense, and we accept no liability for it.

Article 6 (Suspension of the App)

We may suspend or interrupt all or part of the App without prior notice if we determine that any of the following applies:

  1. maintenance, inspection or updating of the computer systems related to the App;
  2. force majeure such as earthquake, lightning, fire, power outage or other natural disaster makes it difficult to provide the App;
  3. computers or communication lines are stopped due to an accident;
  4. the weather data provider's service is suspended or changed; or
  5. we otherwise determine that it is difficult to provide the App.

Article 7 (Copyright)

  1. All copyrights and other intellectual property rights in the App and the Content, except User Images, belong to us or to the rights holders who have licensed them to us.
  2. You may use the App and the Content only within the scope permitted by these Terms.

Article 8 (Advertising)

  1. The App may display advertisements from us or from third parties.
  2. We accept no responsibility for the content of advertisements or for advertisers' websites.
  3. You can remove advertisements by purchasing the paid plan.

Article 9 (Paid Services / Subscription)

  1. The App offers an auto-renewable subscription, "FavoWeather Premium" (monthly). Purchasing it unlocks the benefits shown in the App, such as higher limits on presets and locations, ad removal, appearance customization and Home Screen widgets.
  2. The price shown in the App and on the App Store at the time of purchase applies, and is charged to your Apple account.
  3. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and the fee for the next period is charged at renewal.
  4. You can cancel (turn off auto-renewal) at any time from the subscription management screen of your Apple account in iOS Settings. Deleting the App does not cancel the subscription.
  5. Prices of paid services may change without notice.
  6. Refunds after purchase are subject to the App Store refund policy.

Article 10 (Weather Information)

  1. Weather information shown in the App is based on data from Apple Weather (WeatherKit) provided by Apple Inc. (see License Information).
  2. We make no warranty as to the accuracy, completeness or timeliness of the weather information.
  3. For important decisions such as weather warnings and disaster preparedness, always check information published by official meteorological agencies or local authorities.

Article 11 (Disclaimer)

  1. We make no warranty as to the accuracy, completeness, usefulness or safety of the App.
  2. We accept no liability for any damage you incur through use of the App.
  3. The accuracy of the location information used to show the weather for your current location depends on your device and network environment, and we do not guarantee it.
  4. We accept no liability if your device or data malfunctions as a result of using the App.

Article 12 (Changes to the Service)

We may change the content of the App or discontinue the App without notice to you, and we accept no liability for any damage you incur as a result.

Article 13 (Changes to the Terms)

We may change these Terms at any time without notice when we deem it necessary. The revised Terms take effect when posted in the App or on our website.

Article 14 (Notices)

Notices and communications between you and us shall be made in the manner determined by us.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms are governed by the laws of Japan.
  2. Any dispute relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
